TITLE: MOONLIGHTING

DEFINITIONS:

Moonlighting: Voluntary, compensated, medically-related work performed beyond

a graduate staff member’s (GS’s) clinical experience and education hours and

additional to the work required for successful completion of the program.

• External moonlighting: Voluntary, compensated, medically-related work

performed outside the site (or any of its related participating sites) or

program scope where the GS is in training.

• Internal moonlighting: Voluntary, compensated, medically-related work

performed within the site (or at any of its related participating sites) and

program scope where the GS is in training.

POLICY:

Internal or external moonlighting activities may be inconsistent with requirements

for sufficient time for rest and restoration to promote the educational experience

and safe patient care. Moonlighting must not interfere with the ability of the

resident to achieve the goals and objectives of the educational program, and must

not interfere with the resident’s fitness for work nor compromise patient safety.

GS are never required to engage in moonlighting.

PGY-1 residents, as well as trainees on a visa are not permitted to moonlight.

GS must have written permission from their Program Director to engage in

moonlighting.

Individual Program Directors may decide if moonlighting is permitted in their

programs and may prohibit it. At all times, Program Directors must monitor any

Graduate Staff engaging in any form of moonlighting for any adverse effect on

Graduate Staff performance. A Program Director may withdraw permission for

moonlighting at any time.

GS must submit an official request for moonlighting to the Program Director using

the form provided by the GME Office. This request, if approved by the Program

Director, must be submitted to the GME Office for final approval. GS are advised

that the professional liability coverage extended through their program may apply

to moonlighting within NYPH, but NOT to moonlighting outside the institution.GS must have a full and unrestricted New York State medical license to moonlight

unless the moonlighting is coverage within the site (or at any of its related

participating sites) and the training program scope where the resident or fellow is in

training (“internal coverage”) as approved by the GME Office.

Moonlighting activities are to be counted as part of GS work hours, which will not

exceed work hour limits, but are not counted toward requirements for

successful completion of their program. GS must accurately report the

moonlighting hours to the Program Director; the Program Director is responsible for

monitoring all work hours. This policy applies to ACGME-accredited programs.
